Terms of Service

Effective date: October 19, 2026

These Terms of Service (“Terms”) apply to your use of the TruCut Landscaping website and to estimates, scheduling, and landscaping or lawn-care services provided by TruCut Landscaping (“TruCut,” “we,” “us,” or “our”). By using the website or requesting or accepting our services, you agree to these Terms. A written estimate, invoice, or service agreement may include additional terms for a particular project. If those project-specific terms conflict with these general Terms, the project-specific terms govern that work to the extent of the conflict.

Website Use

Use the website lawfully to learn about our services or contact us. Do not interfere with it, attempt unauthorized access, introduce harmful code, submit false information, or violate another person’s rights. We may change, suspend, or discontinue website content or features at any time. Website information is general and may not describe every service, property condition, or project requirement.

Estimates, Scope, and Scheduling

An estimate is based on the information available when it is prepared and describes the work, materials, assumptions, and pricing included in that estimate. Unless stated otherwise, estimates are not a guarantee that conditions will remain unchanged or that unlisted work is included. The final scope and price are subject to your approval and any written project terms. Additional work, changed materials, or conditions that were not reasonably apparent when the estimate was prepared may require a revised estimate or additional charge, subject to your approval before the added work proceeds.

A request for an estimate or preferred service date is not itself a confirmed appointment or agreement to perform work. Scheduling is confirmed through our communications with you and may depend on weather, season, crew availability, material availability, access, and site conditions. We will make reasonable efforts to communicate schedule changes. A schedule date is an estimate unless we expressly confirm it as a firm commitment in writing.

Services and Site Conditions

The work we provide is limited to the services described in the accepted estimate or other written agreement. Landscaping and lawn-care work depends on conditions such as weather, soil, drainage, sunlight, existing vegetation, pests, prior maintenance, and the condition of the property. These factors may affect timing and results and may be outside our control. We may delay, adjust, or stop work when weather, unsafe conditions, hidden obstacles, or other site conditions make it impractical or unsafe to proceed. We will discuss material changes to scope or price with you.

Plants, seed, sod, and other living or natural materials vary. Their establishment and appearance depend on environmental conditions and ongoing care, including watering and maintenance. Unless a written project agreement expressly states otherwise, we do not guarantee a particular growth, color, yield, or long-term result. Any specific workmanship or material commitment will be described in the applicable written estimate or agreement; these Terms do not create a time-based warranty that is not stated there.

Customer Responsibilities

You must provide accurate project and property information, ensure that we can safely and reasonably access the work area at the agreed time, and secure gates or provide access instructions as needed. Please remove or protect personal property, vehicles, and other items from the work area. You are responsible for identifying and clearly marking private or customer-installed utilities, irrigation lines, lighting, invisible fencing, drainage components, and other hidden features before work begins. You should arrange for required utility marking and tell us about known hazards, sensitive plants, access limitations, or property restrictions.

Please keep children and pets away from active work areas and secure pets during visits. You are responsible for any permissions, approvals, or property-owner consent needed for the work, unless a written agreement says otherwise. If access, markings, or required information are unavailable, work may be delayed, changed, or rescheduled, and additional charges may apply as described in an approved estimate or agreement.

Payment, Cancellations, and Changes

Payment is due according to the accepted estimate, invoice, or other written payment terms provided for your project. Any deposits, progress payments, accepted payment methods, taxes, or additional charges will be stated in those project materials where applicable. If payment is overdue, we may pause work or take other action allowed by the project agreement and applicable law.

Please contact us promptly if you need to cancel or change a scheduled visit or project. Any cancellation notice period, charges for completed work or materials already ordered, and rescheduling terms will be governed by the terms provided with your estimate or agreement and applicable law. We will communicate any proposed changes to the work or charges for your approval where required. Nothing in this section creates a cancellation fee or payment amount that was not disclosed in the applicable project terms.

Text Messages and Communications

If you provide a mobile number and consent to receive texts, we may send service-related messages about your inquiry, estimate, appointment, or requested work. Marketing texts require any consent required by law and are not a condition of purchasing services. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help. See our Privacy Policy for more information about text messages and personal information. You may contact us through the website Contact page to discuss other communication preferences.

Intellectual Property

Website text, photographs, graphics, logos, and other content are owned by or used with permission by TruCut and are protected by applicable intellectual-property laws. You may view the website for personal, noncommercial purposes. You may not copy, modify, distribute, publish, or commercially exploit website content without our prior written permission, except where law permits.

Third-Party Links

The website may link to third-party websites or services for convenience. We do not control or endorse their content, availability, or practices and are not responsible for them. Your use of a third-party site is subject to that site’s own terms and policies.

Limitation of Liability

To the extent permitted by law, TruCut is not liable for indirect, incidental, special, exemplary, or consequential damages arising from website use or services, including loss of use or profits. To the extent permitted by law, TruCut’s total liability for a claim arising from a particular project will not exceed the amount you paid to TruCut for the specific work giving rise to the claim. These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited. Nothing in these Terms waives rights or remedies that applicable law does not allow us to waive.

Indemnity

To the extent permitted by law, you agree to be responsible for claims, losses, and reasonable costs arising from your material breach of these Terms, your unlawful use of the website, or your failure to disclose a known site hazard or mark a customer-installed utility or feature, except to the extent caused by our negligence, misconduct, or other conduct for which applicable law does not permit you to assume responsibility.

Governing Law and Changes

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles. Any dispute will be handled in a court with proper jurisdiction, subject to applicable law. We may revise these Terms by posting an updated version on the website. The effective date above identifies the current version. Continued website use after an update constitutes acceptance of the revised Terms to the extent permitted by law. Changes to a project already accepted do not alter its written scope or price unless agreed by the parties.
